COB Mandate Changes in Clark County

We are making changes to the Coordination of Benefits (COB) Administrative Rule to comply with a new rule issued by the Office of the Insurance Commissioner (OIC).  This new rule applies to all employer groups and individual plans across the board with claim dates of service on or after September 1, 2009.  However, Employee Retirement Income Security Act (ERISA) self-funded groups, Regence administered Boeing plans and ITS Host claims are exempt.

The two major elements to the new rule that will affect the way health plans in the state of Washington process claims in the secondary position.

  1. Secondary payer will no longer be required to estimate claims payment if the primary payer has not paid
  2. The secondary payer will be required to pay primary if the primary carrier has not made payment within 60 days of receipt of the claim

We are sending notification to Clark County employer groups on Tuesday, October 20th.  Attached is a copy of the letter and insert.
